The Full Project Gutenberg License
The Sorrows of Young WertherThe Full Project Gutenberg License is the rule governing use and distribution of electronic works associated with Project Gutenberg. Its opening provisions make access conditional on agreement, distinguish the copyright status of individual works from the collection, and pair broad permission to copy public-domain material with requirements that preserve the license and the Project Gutenberg name. They also specify what happens when a user rejects the terms and begin to define conditions for charging for copies or access.
Purpose and Scope
The license begins with an instruction to read its terms before distributing or using the work. Its stated purpose is to protect the Project Gutenberg mission of promoting the free distribution of electronic works. The agreement applies not only to this particular eBook but also to other works associated in any way with the phrase Project Gutenberg: using or distributing such a work entails agreement to comply with the full license, which is available with the file or online.
The opening section treats reading or using any part of an electronic work as an indication that the user has read, understood, and accepted the license and its intellectual-property and trademark agreement. The rule therefore frames assent as a condition attached to use, rather than as a requirement limited to later redistribution. Someone who does not agree must stop using the work and return or destroy every copy in their possession. If that person paid for a copy or access, the license points to a refund procedure in paragraph 1.E.8.
Copyright, Collection, and Trademark
The license distinguishes the collection from the individual works it contains. The Project Gutenberg Literary Archive Foundation owns a compilation copyright in the collection, while nearly all the individual works are described as being in the public domain in the United States. For a public-domain work used by someone located in the United States, the license says that the Foundation does not claim a right to prevent copying, distribution, performance, display, or the creation of derivative works, provided that all references to Project Gutenberg are removed.
That permission is qualified by the separate rules for retaining the Project Gutenberg name. The Foundation expresses the hope that works will instead be shared under the license, keeping the name associated with them and supporting continued free access. One straightforward route described in the terms is to share the work without charge in the same format, with the full license attached. The license also identifies Project Gutenberg as a registered trademark: it may be used in connection with an electronic work only by people who agree to the agreement, subject to the permitted activities set out in the following paragraphs. Thus public-domain status does not erase the distinction between rights in an individual text, rights in the collection, and conditions on use of the trademark.
Conditions for Access and Redistribution
Paragraph 1.E sets out the conditions that apply unless all references to Project Gutenberg have been removed. Its first requirement is a prominent notice whenever a covered work is accessed, displayed, performed, viewed, copied, or distributed. The notice must include active links to, or provide immediate access to, the full license. For a public-domain work, paragraph 1.E.2 says that copies may be distributed to anyone in the United States without fees or charges, but redistribution or access associated with the Project Gutenberg name must follow the requirements in paragraphs 1.E.1 through 1.E.7 or obtain permission for use of the work and trademark under paragraphs 1.E.8 or 1.E.9.
The terms also address works posted with a copyright holder’s permission. Their use and distribution must follow the listed notice and license requirements as well as any additional terms imposed by that holder; those additional terms are linked to the license at the beginning of the work. The full license must not be unlinked, detached, or removed from the work, or from files containing part of it or another work associated with Project Gutenberg. Nor may a covered work, or any part of it, be copied, displayed, performed, distributed, or redistributed without prominently presenting the required notice and providing access to the full terms.
Format conversion is permitted, including conversion into binary, compressed, marked-up, nonproprietary, proprietary, word-processing, or hypertext forms. That permission carries a condition when the distributed version is not in Plain Vanilla ASCII or another format used in the official version on the Project Gutenberg website: at no additional cost, the distributor must provide the original format, a means of exporting it, or a means of obtaining it on request. Any alternate format must also include the full license as required by the notice provision.
Charges and Refunds
The opening provisions distinguish free redistribution from paid access. Paragraph 1.E.7 prohibits charging for access to, viewing, displaying, performing, copying, or distributing Project Gutenberg works unless the distributor complies with paragraph 1.E.8 or 1.E.9. The excerpted terms begin the conditions in paragraph 1.E.8 for charging a reasonable fee for copies, access, or distribution. They require a royalty equal to 20 percent of gross profits derived from use of the works, calculated using the method already used to calculate applicable taxes. Although the royalty is owed to the owner of the Project Gutenberg trademark, that owner has agreed to donate payments under this paragraph to the Project Gutenberg Literary Archive Foundation.
The same provision sets a payment timetable: royalties must be paid within 60 days after each date on which periodic tax returns are prepared or legally required, clearly marked as royalty payments and sent to the Foundation at the address specified in Section 4. A separate refund condition protects a user who rejects the full license after paying for a copy or access. Written notice, including by email, must be given within 30 days of receipt; the user must return or destroy copies held in a physical medium and discontinue all use of, and access to, other copies of Project Gutenberg works. Together, these conditions make the license’s permission to charge dependent on specified financial and user-remedy obligations, rather than treating paid redistribution as an unrestricted extension of the general permission to copy.
